Terms of Service

The Astro Nova ("the Platform," "we," "us") is an AI-powered astrology platform that provides the following services:

• AI-generated birth chart analysis across Vedic (Jyotish), Western (Tropical), and Chinese astrological systems.
• AI chat consultations, voice calls, and avatar sessions with our AI astrologer.
• Personalized daily, weekly, and monthly horoscopes based on your natal chart.
• Compatibility (Kundli) matching, numerology reports, and tarot readings.
• Vedic remedies including gemstone recommendations, mantra guidance, and ritual suggestions.
• A marketplace connecting users with verified human astrologers for premium consultations.
• An e-commerce shop for astrology-related products (gemstones, yantras, books).

The Platform is accessible via web browsers at theastronova.com and may be made available as a mobile application in the future.

• You must be at least 18 years of age to create an account and use the Platform.
• You may register using Google OAuth or email/password credentials. You are responsible for maintaining the confidentiality of your login credentials.
• You agree to provide accurate, current, and complete information during registration, including your birth details (date, time, and place of birth) which are required for accurate astrological computations.
• One person may maintain only one account. Duplicate or fraudulent accounts may be terminated without notice.
• You are solely responsible for all activity that occurs under your account.
• We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or attempt to exploit platform vulnerabilities.

• Pay-As-You-Go Model: The Astro Nova operates on a credit-based, pay-as-you-go pricing model. You purchase credits and consume them as you use AI services.
• Pricing: AI Chat costs ₹8 per message, Voice Call costs ₹20/minute, and Avatar Session costs ₹35/minute. Prices are exclusive of GST; 18% GST is added at checkout for Indian users and disclosed in the receipt.
• Minimum Recharge: The minimum credit recharge amount is ₹50.
• Credit Policy: Purchased credits are non-refundable once consumed. Unused credits never expire and remain in your account indefinitely. Credits are non-transferable and cannot be redeemed for cash.
• Welcome Bonus: New users receive up to 40 free credits as a graduated welcome bonus (one-time, non-recurring). Welcome credits are non-transferable and provided once per user. Abuse of the welcome bonus (e.g., creating multiple accounts) may result in account termination.
• Payment Processing: Payments in India are processed via Razorpay. International payments are processed via Stripe. All prices are displayed in INR for Indian users and USD for international users.
• Refund Policy: Refunds are governed by our Refund Policy. Consumed credits are non-refundable. Technical failures may qualify for credit restoration.
• Minor safeguarding: The Astro Nova is not intended for users under 18 (see DPDPA s.9 compliance in our Privacy Policy). If our voice-agent's safeguarding system detects that a caller may be a minor during a live session, the call ends immediately, no credits are deducted for the disconnected portion, and a notification is sent to the account owner. Parents or account owners who discover that a minor used the account may request a full refund of the affected session by writing to grievance@theastronova.com.

• AI-generated readings are not a substitute for professional medical, legal, financial, or psychological advice. Always consult qualified professionals for important life decisions.
• Astrological predictions are based on planetary positions and classical interpretive frameworks. They reflect possibilities and tendencies, not certainties.
• The Platform does not guarantee the accuracy, completeness, or reliability of any astrological reading or prediction.
• Users should exercise their own judgment and not rely solely on astrological guidance for critical decisions related to health, finances, legal matters, or relationships.
• Human astrologer consultations available through our marketplace are provided by independent practitioners. The Astro Nova facilitates the connection but does not endorse or guarantee the advice given by individual astrologers.

• Our Content: The Platform, including its design, code, AI models, algorithms, branding (The Astro Nova name and logo), and all original content, is the intellectual property of The Astro Nova and is protected under Indian and international copyright, trademark, and intellectual property laws.
• Your Content: You retain ownership of personal data and content you submit (birth details, chat messages). By using the Platform, you grant us a limited, non-exclusive license to process this data solely for providing astrological services.
• Data Retention: Upon account deletion, all personal content (birth data, chat transcripts, remedy logs, avatar uploads) is erased within 30 days. Account identifiers and authentication logs are preserved for 180 days post-deletion per Rule 3(1)(h) of the IT (Intermediary Guidelines) Rules 2021. Financial records are retained for 7 years as required by CGST Rule 56 and the Income Tax Act 1961, s.44AA. AI consultation logs are anonymised after 24 months.
• Generated Content: AI-generated readings, charts, and reports are provided for your personal use. You may share your own readings but may not bulk-reproduce, resell, or commercially distribute AI-generated content without written permission.
• Restrictions: You may not reverse-engineer, decompile, or extract the AI models, scrape content, or use automated tools to access the Platform beyond its intended interface.

• The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
• To the maximum extent permitted by applicable law, The Astro Nova shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.
• Our total aggregate liability for any claims arising from these Terms or your use of the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim.
• We are not liable for any decisions made or actions taken based on astrological readings or guidance provided through the Platform.
• We do not guarantee uninterrupted, error-free, or secure access to the Platform. Service may be subject to delays, interruptions, or errors beyond our control.

• These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law provisions.
• Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
• Before initiating formal legal proceedings, you agree to attempt resolution through good-faith negotiation. Contact us at grievance@theastronova.com with a detailed description of your concern. We acknowledge within 24 hours and aim to resolve within 15 days per Rule 3(2)(a) of the IT (Intermediary Guidelines) Rules 2021.
• Consumer rights (Consumer Protection Act 2019): You retain the right to approach a District, State, or National Consumer Disputes Redressal Commission, or to file online via the e-Daakhil portal. Every complaint receives a unique ticket number for traceability, in compliance with Rule 5(3) of the Consumer Protection (E-Commerce) Rules 2020.
• Arbitration under the Arbitration and Conciliation Act, 1996 is available only where both parties consent in writing after the dispute has arisen; we do not mandate arbitration as a condition of service (per Emaar MGF Land Ltd v. Aftab Singh, 2018).

In compliance with Rules 3(1)(j) and 4(3) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021, we maintain a dedicated channel for law-enforcement agencies (LEAs) and regulatory requests.

Under Rule 3(1)(h) of the IT Rules 2021, we preserve user-account identifiers and authentication metadata for 180 days post-deletion for lawful LEA cooperation; this is separate from our 30-day personal-content erasure and 7-year financial-record retention obligations.

Valid legal requests (under s.69 of the IT Act 2000, CrPC s.91, or a competent court order) will be honoured. Bulk or overbroad requests will be challenged where legally permissible.
